No special panel for petition font case, COA says

The collective Michigan Court of Appeals voted against commissioning a special panel to reconsider its 2002 holding in Bloomfield Charter Twp. v. Oakland County Clerk.

The special panel was requested in last week’s decision in Stand Up for Democracy v. Sec. of State. The panel said that the plaintiff’s petition was printed in the wrong font, which should invalidate it. Prior case law in Bloomfield, however, prevented the panel from invalidating the petition. The panel felt Bloomfield was wrongly decided, so it stayed its decision and requested a special panel to consider overturning the case.
